নারায়ণগঞ্জ বার্তা ২৪ : রাষ্ট্রধর্ম ইসলাম চ্যালেঞ্জ করে ২৮ বছর পূর্বে করা রিট আবেদন সরাসরি খারিজ করে দিয়েছেন হাইকোর্ট। ২৮ র্মাচ সোমবার বিচারপতি নাঈমা হায়দার, বিচারপতি কাজী রেজা-উল হক ও বিচারপতি মো. আশরাফুল কামালের সমন্বয়ে গঠিত হাইকোর্টের বিশেষ বেঞ্চ এ আদেশ দেন। রিট আবেদনকারীদের পক্ষে ছিলেন আইনজীবী জগলুল হায়দার আফ্রিক ও সুব্রত চৌধুরী। রাষ্ট্রপক্ষে ছিলেন অতিরিক্ত অ্যাটর্নি জেনারেল মুরাদ রেজা।

এদিকে সংবিধান থেকে রাষ্ট্রধর্ম ইসলাম বাদ দেওয়ার প্রতিবাদে জামায়াতের ডাকা সকাল-সন্ধ্যা হরতালে নারায়ণগঞ্জে কোনো প্রভাব পড়েনি। সোমবার ২৮ মার্চ সকাল ৬টা থেকে শুরু হওয়া এ হরতালে শহরের সকল সড়কগুলোতে সব ধরনের যান চলাচল স্বাভাবিক রয়েছে। চলছে স্কুল কলেজ, অফিস আদালত গুলোও র্পূবের ন্যায় ব্যাস্তমূখর।

অপরদিকে হরতালকে কেন্দ্র করে যেকোন নাশকতামূলক কর্মকান্ড এড়াতে গুরুত্বপূর্ণ স্থানগুলোতে মোতায়ন রয়েছে আইন-শৃঙ্খলা রক্ষাকারী বাহিনীর সদস্যরা। হরতালের ব্যাপারে জেলা পুলিশের পক্ষ থেকে আগেই বলা হয়েছে যেকোনো নাশকতা কঠোর হাতে দমন করা হবে, এ ক্ষেত্রে কাউকে ছাড় দেওয়া হবে না।

উল্লেখ্য, ১৯৮৮ সালে সংবিধানের অষ্টম সংশোধনীর মাধ্যমে সংবিধানে রাষ্ট্রধর্ম হিসেবে ইসলামকে সংযুক্ত করেন তৎকালীন রাষ্ট্রপতি হুসেইন মুহম্মদ এরশাদ। সংবিধানে ২ (ক) অনুচ্ছেদ যুক্ত করে বলা হয়, প্রজাতন্ত্রের রাষ্ট্রধর্ম হবে ইসলাম, তবে অন্যান্য ধর্মও প্রজাতন্ত্রে শান্তিতে পালন করা যাবে। তখন স্বৈরাচার ও সাম্প্রদায়িকতা প্রতিরোধ কমিটির পক্ষে রাষ্ট্রধর্মের ওই বিধানের বৈধতা চ্যালেঞ্জ করে হাইকোর্টে রিট আবেদন করেছিলেন দেশের ১৫ জন বরেণ্য ব্যক্তি। তাঁদের মধ্যে ১০ জন মারা গেছেন। তাঁরা হলেন সাবেক প্রধান বিচারপতি কামালউদ্দিন হোসেন, বিচারপতি দেবেশ চন্দ্র ভট্টাচার্য, বিচারপতি কে এম সোবহান, কবি সুফিয়া কামাল, অধ্যাপক খান সারওয়ার মুরশিদ, জ্যেষ্ঠ আইনজীবী সৈয়দ ইশতিয়াক আহমেদ, অধ্যাপক কবীর চৌধুরী, শিল্পী কলিম শরাফী, অধ্যাপক মোশাররফ হোসেন ও সাংবাদিক ফয়েজ আহমদ।

আবেদনকারীদের মধ্যে এখন জীবিত পাঁচজন হলেন অধ্যাপক সিরাজুল ইসলাম চৌধুরী, সেক্টর কমান্ডার সি আর দত্ত, বদরুদ্দীন উমর, বোরহানউদ্দিন খান জাহাঙ্গীর ও অধ্যাপক আনিসুজ্জামান। রিট আবেদনের ২৩ বছর পর ২০১১ সালের ৮ জুন বিচারপতি এ এইচ এম শামসুদ্দিন চৌধুরী ও বিচারপতি গোবিন্দ চন্দ্র ঠাকুরের সমন্বয়ে গঠিত হাইকোর্ট বেঞ্চ রুল দেন। ওই দিনই অ্যামিকাস কিউরি হিসেবে ১৪ জন জ্যেষ্ঠ আইনজীবীকে নিয়োগ দেওয়া হয়। তাঁদের মধ্যে দুজন ড. এম জহির ও সাবেক অ্যাটর্নি জেনারেল মাহমুদুল ইসলাম মারা গেছেন। বাকি ১২ জন হলেন টি এইচ খান, ড. কামাল হোসেন, রফিক-উল হক, এম আমীর-উল ইসলাম, এ এফ হাসান আরিফ, রোকনউদ্দিন মাহমুদ, আখতার ইমাম, ফিদা এম কামাল, আজমালুল হোসেন কিউসি, আবদুল মতিন খসরু, ইউসুফ হোসেন হুমায়ুন ও আফম মেজবাহ উদ্দিন। রুল জারির প্রায় পাঁচ বছর পর চলতি বছরের ৮ মার্চ এই রুল শুনানির জন্য আদালতে উঠে। ঐদিন আদালত অ্যামিকাস কিউরিদের বাদ দিয়ে শুনানির জন্য আজকের দিন ধার্য করেন।
